Letter of Agreement

Seniority Sideletter

THIS LETTER OF AGREEMENT is made and entered into in accordance with the provisions of the Railway Labor Act, as amended, by and between America West Airlines, Inc. (hereinafter referred to as the "Company"), and the FLIGHT ATTENDANTS in the service of AMERICAN WEST AIRLINES, INC., as represented by the ASSOCIATION OF FLIGHT ATTENDANTS, AFL-CIO (hereinafter referred to as the "Union").

WHEREAS, the Company and the Union desire to supplement their Basic Agreement signed, _______________________, (hereinafter referred to as the "Agreement"), by providing certain rates of pay and work rules with respect to Seniority.

NOW THEREFORE, it is hereby mutually agreed and understood by and between the parties to this Letter of Agreement that the seniority of certain Flight Attendants described below, who transferred to another position prior to the effective date of the Agreement shall be as follows:

If the Flight Attendant’s transfer was to a management or supervisory position in the InFlight Department and occurred less than three (3) years prior to the effective date of the Agreement, then she/he shall be regarded as having retained her/his credited service as a line Flight Attendant (i.e., service earned before transfer) and as having continued to accrue seniority as a Flight Attendant for up to three (3) years from the date of her/his transfer. If she/he returns to active flight status within that three (3) year period, she/he shall be placed on the Seniority List based on her prior credited service as a line Flight Attendant and Flight Attendant seniority accrued while a manager/supervisor. If she/he does not return to active flight status within that three (3) year period, she/he shall forfeit all Flight Attendant seniority and her/his name shall be removed from the Seniority List. If she/he thereafter returns to service as a Flight Attendant, her/his placement on the Seniority List shall be as set forth in Section 19, Seniority, Paragraph A.7.

This letter of Agreement shall remain in full force and effect concurrently with the Collective Bargaining Agreement.
