SECTION 28 - UNION BUSINESS

A. UNION MATERIALS

1. The Company shall provide space for a bulletin board at each Flight Attendant domicile or Company-designated hub(s) for posting Union materials authorized by the MEC/LEC President(s). The bulletin board shall only be used for posting notices of Union social and recreational affairs, Union elections, results of Union elections, Union meetings, and notices pertaining to the administration of this Agreement. There shall be no other general distribution or posting by Flight Attendants or the Union, except as provided in this section, unless the MEC/LEC President(s) and the Director of Inflight or her/his designee mutually agree that a proposed posting is appropriate. Any notices posted that are not in accordance with this provision shall be removed by the Union unilaterally or at the Company's request.

2. The MEC/LEC officers, or their designee(s), shall be allowed to use V-files, provided by the Union, for distribution of official Union materials. The content of documents placed in the V-files shall be limited to the subjects which may be placed on the bulletin board or any exceptions as mutually agreed by the MEC/LEC President(s) and the Director of Inflight or her/his designee, as provided in Paragraph A.1 above. The Company shall provide adequate space for Union V-files at each domicile or Company-designated hub(s).

B. UNION FLIGHT PAY LOSS

1. A request by the Union for the release of a Flight Attendant attending to Union business shall be made to the Director of Inflight with a copy to Crew Resources. Such request(s) shall be signed by the MEC/LEC President(s) or an officer of the MEC. This request(s) shall be transmitted to the Company by facsimile as far in advance as practicable. The request(s) will indicate name(s), date(s), Company I.D number(s), and duration of the release(s) requested.

2. The Union shall notify the Company as far in advance as practical when leaves for Union business are either canceled or rescheduled.

3. In the event of staffing shortages, the Director of Inflight or Crew Resources will inform the Flight Attendant and/or MEC that the Company is unable to provide a release. The Flight Attendant may on her/his own attempt to arrange for another Flight Attendant to fly her/his trip(s). However the Company must approve such an arrangement in advance to ensure that both Flight Attendants are able to work the trip(s) (e.g., are legal) and are otherwise available to fly their remaining assignments during the bid period. The provisions of this subparagraph shall not apply to MEC officers, the Union Negotiating Committee (while in active negotiations), and one (1) Committee Chairperson whom the MEC President may designate not more than once per week.

4. Each Flight Attendant, upon early return from scheduled Union business, shall contact Crew Resources immediately to advise of her/his availability for duty.

5. A Flight Attendant who is released from duty shall be kept whole by the Company as to pay and credit for all trips missed, seniority and longevity accrual, and benefits as if she/he had performed the duty from which she/he was released for Union business.

6. The Company shall invoice the Union each month for reimbursement of payments actually made to a Flight Attendant to keep her/him whole. The amount invoiced shall include the Flight Attendant's compensation, her/his share of payroll taxes and her/his normal contributions for insurance coverage or retirement and workers' compensation. The fringe benefit override currently is twenty-seven percent (27%) and shall remain in effect for the duration of this Agreement.

7. The Company shall submit the invoice to the Union and the MEC President simultaneously each month. The Union shall pay such invoice within thirty (30) days after receipt.

C. GENERAL

1. Union representatives shall be afforded an opportunity at the end of each new hire Flight Attendant training program to address the new hire class for a maximum of two (2) hours.

2. The Company shall provide free transportation over its routes on a space available basis (SA4B) for Union staff members for the purpose of conducting business with the Company.

3. The Company shall provide the MEC President with a copy of the following periodic reports:

a. A monthly reserve tracking report reflecting reserve assignments; reserve credit, reserve releases (a.m./p.m. or full release) as of the 30/31st. The report will be available no later than the 16th of the month for the previous month's reserve activity.

b. A copy of reserve schedules with cumulative total hours as of the 16th of the current month shall be faxed to the Union office no later than the 18th of the current month.

c. Periodic reports issued on canceled variable staffing trips.

d. Periodic reports on notification of implementation of junior assignment mode.

e. Periodic reports of bidding/on line and furlough lists.

f. Lists of new-hire or recalled Flight Attendants and their seniority and employee numbers.

    1. A Flight Attendant on a Union Leave of Absence shall receive the same pass privileges as other employees on leaves. A Flight Attendant on a Union Leave shall retain and accrue seniority and longevity.

5. The provisions of Paragraph B.5., above, shall govern all Flight Attendants on Union leave of absence, including leaves to serve as an International Officer or Union staff member.
