SECTION 21 - FURLOUGH/DISPLACEMENT/RECALL A. 1. When a reduction in the number of active Flight Attendants is necessary, the Company shall simultaneously offer voluntary and involuntary furloughs. 2. A Flight Attendant shall have ten (10) days from the posting of a furlough notice to submit on a company provided form, her/his request for a voluntary furlough. The furlough notice shall be posted on the bulletin boards at each domicile or hub location and in the Inflight briefing. Voluntary furloughs shall be awarded in seniority order. 3. Any Flight Attendant who accepts a voluntary furlough shall be subject to the provisions of this Section. B. 1. The Company shall notify the MEC/LEC President(s) of the projected number of Flight Attendants to be involuntarily furloughed/displaced and the projected duration of time that the reduction in force will be in effect. The Company shall also provide an up-to-date Seniority List to the MEC/LEC President(s). 2. The Company shall impose involuntary furloughs in inverse seniority order. A Flight Attendant furloughed during her/his probationary period shall have recall rights for one (1) year from the date of her/his furlough. 3. A Flight Attendant shall retain seniority throughout any furlough, shall accrue longevity for the first thirty (30) days of the furlough, and shall retain recall rights for five (5) years from the effective date of the furlough or until she/he forfeits her/his recall rights, whichever occurs first. When this period expires, any Flight Attendant still on furlough shall lose all seniority and recall rights, and her/his name shall be removed from the Flight Attendant System Seniority List. 4. a. A Flight Attendant who is displaced from her/his original domicile as a result of a furlough or who bumps into another domicile to avoid being furloughed shall retain seniority and a preferential right to recall to the domicile from which she/he was displaced ("the original domicile") until she/he has had an opportunity to return to that domicile. b. In order to retain the right of recall to her/his original domicile, it shall be the Flight Attendant's responsibility to submit a transfer request to the Company indicating her/his desire to return to that domicile. c. If a Flight Attendant has transferred to another position pursuant to provisions of Section 19, Seniority, and subsequently receives a furlough notice from the Inflight department, the following provisions shall apply: i. She/He shall retain rights to a Flight Attendant position for five (5) years and shall retain and accrue inflight longevity for thirty (30) days from the effective date of furlough. ii. If a furloughed Flight Attendant is terminated from any department, she/he shall lose her/his recall rights to the Flight Attendant position. However, a Flight Attendant who resigns from any department shall be on furlough status and shall retain recall rights as provided herein. iii. If a Flight Attendant receives a recall notice and declines to accept the recall to Inflight, the Flight Attendant shall forfeit all rights under this Agreement and shall be removed from the Flight Attendant System Seniority List. 5. The Company shall not fill any Flight Attendant positions with an internal transfer while any Flight Attendant is on furlough. For the purposes of this Section, an internal transfer is defined as a company employee who does not have a current inflight seniority number and whose name does not appear on the Flight Attendant System Seniority List. C. When a domicile is closed, or staffing is reduced resulting in furloughs, an affected Flight Attendant shall be allowed to exercise her/his seniority right to bump into any domicile which her/his seniority will allow. All such moves shall be considered as being at the request of the Company and the Flight Attendant shall receive relocation expenses, as provided in Section 24, Moving Expenses. D. A furloughed Flight Attendant shall be responsible for providing the Company with any changes to her/his current address and telephone number. The Flight Attendant shall contact the Human Resources Department with any changes, regardless of the Flight Attendant's status, by certified mail. E. 1. Pass privileges on America West Airlines shall continue for a furloughed Flight Attendant and her/his eligible dependents in accordance with Company policy. Travel on other airlines while on furlough is subject to the Company's inter-line agreement with each carrier. 2. Notwithstanding the provisions of Paragraph E.1. above, the Director of Inflight shall authorize space available passes where appropriate for a furloughed Flight Attendant and her/his eligible dependents for a period of one (1) year following the start of the furlough. This policy is intended to be solely for job searches, relocation, house hunting, or similar travel requirements. The Company may require documentation of the circumstances giving rise to the request. F. A furloughed Flight Attendant shall be eligible for relocation days and expenses as provided in Section 24, Moving Expenses. G. A furloughed Flight Attendant shall receive her/his accrued vacation in a lump sum payment at the start of the furlough. H. RECALL TO DUTY 1. A furloughed Flight Attendant shall remain on the recall list for five (5) years from the date of her/his furlough and shall be recalled to duty in seniority order. At the end of the five (5) year recall period, any Flight Attendant who is still furloughed shall be removed from the Flight Attendant System Seniority List. 2. If a Flight Attendant is a full-time student at an accredited college, university or trade school at the time she/he receives a recall notice as provided below, at the Flight Attendants option, she/he may defer her/his return to duty date until the end of the current quarter, semester or trimester, provided a position is then available. If no position is available, the Flight Attendant shall be the first to receive the next recall opportunity and must then either accept or reject the recall. If she/he rejects or does not respond to the next recall, the Flight Attendant shall lose all recall rights and her/his name shall be removed from the Flight Attendant System Seniority List. The Company may require documentation confirming enrollment in the educational institution. 3. A Flight Attendant shall be recalled from furlough in seniority order. Except as provided in Paragraph H.2., above, a Flight Attendant who declines recall, or who fails to respond to a recall notice as provided herein shall be removed from the Flight Attendant System Seniority List. When the Company executes a recall to duty, all base transfer requests within the Inflight department shall be frozen in order to accommodate the preferential recall rights of a furloughed and/or displaced Flight Attendant wishing to return to her/his original domicile. 4. When recalling a Flight Attendant, the rights specified in Paragraph B.4.a., above, shall be honored to the extent that available openings exist. If the original domicile of a Flight Attendant being recalled is not available, she/he shall indicate her/his domicile preference from those domiciles with available positions. Domicile preferences shall be awarded in seniority order. A Flight Attendant who is recalled to a domicile other than her/his original domicile shall retain the rights specified in Paragraph B.4.a., above. 5. The Company shall mail a notice of recall at least twenty-one (21) days prior to the date the Flight Attendant must report for duty, differences training, or requalification training.
