SECTION 15 - SICK LEAVE

A. INITIAL SICK LEAVE GRANT

1. On the effective date of this Agreement, the Company shall grant each Flight Attendant an annual sick bank of forty-five (45) credit hours. This sick bank is in lieu of, and not in addition to, any sick leave grants in place prior to the effective date of this Agreement. A Flight Attendant on a furlough or leave of absence on the effective date of this Agreement shall be granted a forty-five (45) credit hour sick leave bank upon her/his return to active status.

2. A Flight Attendant hired after the effective date of this Agreement will be granted a sick bank of forty-five (45) credit hours upon their successful completion of probation.

3. Any sick leave used in calendar year 1999 prior to the effective date of this Agreement shall be deducted from the initial sick leave grant.

B. SUBSEQUENT SICK LEAVE GRANTS

1. A Flight Attendant will receive an annual grant of forty-five (45) credit hours for sick leave. A new hire Flight Attendant will be granted a sick bank of forty-five (45) hours upon the successful completion of her/his probationary period. A Flight Attendant on furlough or leave when subsequent grants are made will receive a prorated grant upon her/his return to active status.

    1. For each calendar year in which the Flight Attendant work force sick leave usage is at or below 2.8% of the total annual credit hours, fifty percent (50%) of a Flight Attendant’s most recent annual accrual (up to 22.5 hours) may be carried into the following year, with a maximum carryover of seventy-five (75) hours. A maximum of one hundred twenty (120) hours of sick leave will be available in any one year (up to 75 carryover hours plus the 45 hour grant).
    2. The Company shall meet with the Union on a quarterly basis to review the quarterly and year-to-date sick leave usage data.
    3. The percentage of total credit hours will be measured each year in the same manner as in 1998, which yielded a percentage of 2.8%.

5. Flight Attendants on a leave of absence shall retain and accrue sick leave as set forth in Section 14, Leave of Absence and Section 17, On the Job Injury/Illness. Flight Attendants on furlough shall retain their sick leave and Perfect Attendance OJI banks.

C. SICK LEAVE USAGE

    1. All sick leave hours shall be paid at the Flight Attendant’s current hourly rate. Flight Attendants shall be paid and credited for all trips or duty periods missed, up to the Flight Attendant's original line projection, for a maximum of seventy-five (75) hours, provided that the Flight Attendant’s sick leave bank has sufficient hours to cover the lost time.
    2. A Flight Attendant shall have the option of not being paid for trip hours missed, provided they inform Crew Resources at the time they call in sick that they do not want the missed hours charged to their sick bank. If a Flight Attendant does not exercise this option when she/he calls in sick, the missed hours will be charged to her/his sick bank.
    3. A Reserve who is grandfathered in accordance with Section 3, Compensation, who has a minimum guarantee of seventy-five (75) credit hours shall be charged with the reserve minimum daily guarantee (4:10 hours) for each day of sick leave.
    1. All other Reserves who have a minimum guarantee of seventy (70) credit hours shall be charged with the reserve minimum daily guarantee (3:53 hours) for each day of sick leave.
    2. When a Flight Attendant is on sick leave for an entire bid period, she/he shall have the option of receiving sick leave pay for her/his awarded bid line for that month, up to seventy-five (75) hours, if she/he has sufficient sick leave accrued.
    3. A Flight Attendant shall notify Crew Resources of an illness as far in advance as possible of her/his scheduled trip report time or the commencement of reserve duty, but sick-calls must be made at least two (2) hours before the scheduled report time or commencement of Reserve duty. A Flight Attendant shall call Crew Resources personally, unless she/he is physically unable to do so. Crew Resources will not discuss the nature of the illness or injury, question the illness or injury, or request a doctor's note from a Flight Attendant.
    4. A Flight Attendant will be required to call-in sick for every day of her/his trip. If she/he is able to return to work during the duration of her/his trip she/he will be returned to her/his original trip if practicable. If not practicable, the Flight Attendant may, at her/his option, sit Guaranteed Reserve. If the Flight Attendant chooses not to sit Guaranteed Reserve she/he will forfeit the pay and credit for the remainder of the trip.
    5. A Flight Attendant may use sick time to care for the illness or injury of a spouse, parent or child.

D. PERFECT ATTENDANCE ON THE JOB IINJURY/ILLNESS (OJI) BANK

1. If a Flight Attendant has perfect attendance (as defined in Section 14, Leaves of Absence, Paragraph G.1.) during each complete calendar quarter (i.e., January - March, April - June), following the effective date of the Agreement, she/he shall accrue 7.9 hours per quarter in a Perfect Attendance OJI Bank. The Flight Attendant may accrue up to a cap of sixty (60) hours in her/his Perfect Attendance OJI Bank.

2. The Perfect Attendance OJI Bank may only be used during an OJI Leave as provided in Section 17, On the Job Injury/Illness.

3. The Company shall provide each Flight Attendant with a written report of her/his current Perfect Attendance OJI Bank balance on the second paycheck of each pay period.

E. GENERAL

1. A Flight Attendant’s sick bank shall not be charged on scheduled days off.

2. The Company shall maintain records of all sick leave use and shall provide each Flight Attendant with a written report of her/his current sick leave balance on the second paycheck each pay period.

3. The Inflight Department may request a doctor's note to verify an illness or injury. The Company shall pay for such examinations conducted at the America West Clinic. The Flight Attendant must submit the receipt to the Company for reimbursement.

4. A Flight Attendant will not be paid for accumulated sick/Perfect Attendance OJI Bank if her/his employment with the Company ceases for any reason.

5. Except as may otherwise be provided in this Agreement, sick leave credit may not be used while on leave status.
